Terms of Service

These terms are an agreement between you and Clip-It.AI, based in Washington, DC, United States ("Clip-It.AI", "we", "us"). They cover your use of the Clip-It.AI website, desktop app, mobile apps and related services (the "Service"). By using the Service you agree to these terms and to our Privacy Policy.

1. The Service

Clip-It.AI analyses your stream recordings, suggests short clips, edits them, and writes titles, captions and hashtags for them. When you approve a clip, Clip-It.AI publishes it to the social media accounts you have connected. Clip-It.AI uses automated tools, including AI, to choose and edit clips and to write text. Its suggestions may not always be accurate or appropriate, so check each clip before you approve it.

Nothing is published without your approval, or without a schedule or auto-approve setting that you turned on yourself.

You own your recordings and the clips made from them ("Your Content"). You give us a worldwide, non-exclusive, royalty-free licence to store, copy, analyse, edit, transform and transmit Your Content, only as needed to provide the Service to you, including publishing to the accounts you connect. This licence ends when Your Content is deleted from our systems, as described in our Privacy Policy.

You confirm that you have all the rights and permissions needed for Clip-It.AI to edit and publish Your Content. That includes rights in any games, music, artwork, overlays, other people's voices or likenesses, and viewers' names or messages that appear in it. You are responsible for following each platform's rules, and the publisher's rules for any game you stream.

We do not use Your Content to train AI models.

4. Connected platforms

When you connect TikTok, YouTube, Instagram or Facebook, you authorise us to act on that account as described when you connect it. Your use of those platforms is governed by their own terms, including the YouTube Terms of Service. We are not responsible for how platforms treat your content: whether they remove it, limit its reach or change their features. Platforms can change or withdraw API access, and when they do, some features of the Service may stop working.

We grant you a personal, non-transferable licence to use the Clip-It.AI apps while your account is active. We own the Service, including its software, design and brand. Feedback you send us may be used to improve the Service.

8. Availability and changes

We work to keep the Service running, but we do not promise it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue a paid plan, we will refund any fees you have paid for the unused period.

9. Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Nothing in these terms limits liability that cannot be limited by law. That includes liability for death or personal injury caused by negligence, for fraud, and your statutory rights as a consumer.

Subject to that, we are not liable for indirect or consequential losses. We are also not liable for loss of profits, revenue, followers or audience reach, or for actions taken by social media platforms. Our total liability to you in any 12 months is limited to the greater of the fees you paid us in that period and US$100.

10. Ending these terms

You can stop using the Service and close your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we have to for legal reasons. When your account closes, we delete your data as described in our Privacy Policy.

11. General

We may update these terms. If the changes are significant, we will give you notice before they take effect. If you keep using the Service after that, you accept the new terms. These terms are governed by the laws of the District of Columbia, USA, without regard to its conflict-of-laws rules, and the local and federal courts located in the District of Columbia have jurisdiction. If you are a consumer outside the US, you also keep the protection of the mandatory laws of the country where you live, and you can bring claims there.

You agree to indemnify us against claims by third parties that arise from Your Content or your breach of these terms.
